1

Scope

These Terms and Conditions (T&Cs) apply to all treatment agreements between Dentalaesthetics – Dr. Muhlis Akarsu (hereinafter "Dentist") and patients (hereinafter "Patient") for dental and oral-surgical services and related treatments.

Deviating conditions of the Patient are only recognised if the Dentist expressly agrees to them in writing.

The basis for treatment is always the dental consultation and the Patient's informed consent in accordance with the Austrian Dental Act (ZÄG) and the General Civil Code (ABGB).

2

Treatment Agreement & Informed Consent

2.1 The treatment agreement is concluded upon booking an appointment and/or the commencement of dental treatment.

2.2 Before each procedure the Patient must be fully informed about the type, scope, risks and alternatives of the treatment. Consent may be given verbally or in writing; for surgical procedures written consent is obtained.

2.3 Treatment and cost plans are prepared following a thorough examination and are non-binding unless expressly agreed as a fixed price.

2.4 The Patient is obliged to provide complete and truthful information about all matters relevant to treatment (pre-existing conditions, medications, allergies).

3

Fees & Payment

3.1 Billing is based on the current fee schedule of the Austrian Dental Chamber and individual agreement on the basis of the treatment and cost plan.

3.2 As a private practice, invoices are issued directly to patients; direct billing with the ÖGK (public health insurance) does not take place. Upon request, patients with public insurance receive an invoice for submission to their health insurer.

3.3 Fees are due upon completion of treatment or in accordance with an agreed payment plan.

3.4 For treatments exceeding €500 a deposit of up to 30% may be agreed.

3.5 In the event of late payment, statutory default interest and reminder fees will be charged.

3.6 Laboratory costs (dental technician, dental laboratory) are itemised separately and passed on.

4

Appointments & Cancellations

4.1 Appointments are binding. Cancellations must be made at least 24 hours before the scheduled appointment.

4.2 In the event of a no-show or short-notice cancellation (less than 24 hours), a cancellation fee equivalent to the value of the missed appointment may be charged.

4.3 For emergencies and acute pain, short-notice appointments are offered where possible.

5

Scope of Services

5.1 The scope of treatment is defined by the treatment and cost plan and/or the dental consultation.

5.2 The Dentist is entitled to refer patients to specialists or hospitals if medically necessary.

5.3 Additional services that prove necessary based on clinical findings will be communicated to the Patient in advance and agreed separately.

6

Warranty

6.1 The Dentist warrants professionally performed dental treatments in accordance with the current state of dental medicine and the guidelines of the Austrian Society for Oral, Dental and Maxillofacial Medicine (ÖGZMK).

6.2 Warranty claims are subject to regular attendance at recommended check-ups and prophylaxis appointments as well as good oral hygiene on the part of the Patient.

6.3 For dental laboratory work (crowns, bridges, dentures) a warranty of 2 years from insertion applies, provided the restoration is cared for correctly.

6.4 Warranty claims must be reported in writing without undue delay.

7

Liability

7.1 The Dentist is liable for intent and gross negligence in accordance with statutory provisions.

7.2 In cases of minor negligence, liability is limited to breaches of material treatment obligations.

7.3 Liability for damage resulting from injury to life, body or health remains unaffected.

7.4 No liability is accepted for complications arising from incomplete or incorrect information provided by the Patient.

7.5 The biological healing process and individual response to treatment are beyond the Dentist's control and do not give rise to liability.

8

Data Protection & Professional Confidentiality

8.1 The practice is subject to professional confidentiality pursuant to § 9 ZÄG. Patient data is treated as strictly confidential and processed solely for the purposes of treatment and legally required documentation.

8.2 The processing of personal data is carried out in accordance with Art. 6(1)(b) and (c) GDPR. Full details are set out in the Privacy Policy.

8.3 Patient documentation is retained in accordance with statutory retention periods (minimum 10 years).

9

Withdrawal & Termination

9.1 The Patient may withdraw from further treatment at any time and without giving reasons. Services already rendered and material costs incurred are to be reimbursed.

9.2 The Dentist is entitled to refuse or discontinue treatment for substantiated reasons, provided this is medically justifiable and the Patient is given sufficient time to find an alternative practitioner.

10

Final Provisions

10.1 Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

10.2 The place of jurisdiction for commercial parties is Vienna. For consumers, the Patient's place of residence or Vienna applies.

10.3 Should individual provisions of these T&Cs be or become invalid, the validity of the remaining provisions remains unaffected.

10.4 Complaints may be addressed to the Vienna Patient Ombudsman and to the Dental Chamber for Vienna.
